Types of Cases We Represent
At the Doan Law Firm, we limit our law practice to representing clients
who suffered an injury due to the carelessness or negligence of others.
In our law practice, we have represented clients whose injuries ranged
from the relatively uncomplicated, those injuries where the accident victim
made a complete recovery to their pre-accident health, to those whose
injuries required months of specialized care.
Our practice also represents those accident victims who have suffered catastrophic
injuries to their brain or spinal cord. In these tragic cases, the survival
of the accident victim is often only clearly established after weeks or
months of specialized (and expensive) medical, surgical, and nursing care.
The following section offers only an overview of the types of cases that
we will represent. More detailed information is available by clicking
the “Personal Injury” link at the top of this page, by calling
us at (979) 803-0000, or via our “Contact Us” form located
on this page.
- Injuries due to defective and/or dangerous products
When you purchase a consumer product, you have the right to expect that
product will “perform as advertised.” If this is not the case,
and that product causes you to suffer an injury, you may have grounds
for a defective or dangerous product lawsuit. Note that many defective
product lawsuits have involved prescription medications and implanted
surgical devices such as artificial joints or “hardware” used
in various surgical operations.
- Public facility or public entertainment accidents
It is a fundamental premise of law that anyone operating a public facility,
whether for entertainment, retail shopping purposes, or any other purpose has the legal duty to take every reasonable precaution
to protect visitors to that facility from suffering an injury. If a visitor
or patron suffers an injury, and that injury could have been prevented,
the owner of the facility may be liable for damages that must be paid
to the injured party.
- Private transportation accidents
Private accident injuries are those accidental injuries involving personal
or private transportation such as an individual’s personal automobile,
motorcycle, or even private boats. The designation “private”
is used to describe ownership by an individual who does not charge a fee
of some type as a condition of use of that vehicle.
- Public transportation accidents
Unlike private transportation, public transportation is any method of transportation
offered to the public for a fixed price or a per-mile fare. In the past,
public transportation has meant city buses, commuter trains, taxi cabs,
or privately-operated tour buses and limousines. In recent years, this
definition has been expanded to include “ride-sharing” or
“on-call” transportation services such as Lyft and Uber. Even
“courtesy” transportation that is routinely provided by hotels
and casinos is considered by law to be “public” transportation.
- Employment-related injuries
Although the State of Texas has always had a “generous” Worker’s
Compensation program, it is far from being a perfect system. In some types
of on-the-job injuries, it may be necessary to file a lawsuit to be certain
a worker injured while at work will receive all the compensation to which
he or she is entitled.
- Injuries sustained by victims of violent crimes
Many people are unaware that Texas law holds that anyone who causes an
injury to another while committing a criminal act, or deliberately causes
an injury that could have been avoided, can be sued in civil court regardless
of the status of any criminal charges. In fact, Texas law allows the victim
of such injuries to argue that the person responsible for the injury was
deliberately negligent simply because the injury occurred during a criminal act!
Under Texas law, a
wrongful death is defined to be any death that is officially attributed to anything other
than “natural causes” or to “acts of God.” Wrongful
deaths, because they cause such substantial disruptions in the victim’s
survivors’ family life, may result in large damage awards to those
