Risperdal Lawsuit Attorney
Risperdal is an antipsychotic often used as a treatment for mental disorders,
including schizophrenia and bipolar disorder. Schizophrenia causes disturbed
thoughts, loss of interest in life, and strong emotions. Bipolar disorder
causes a person to experience abnormally excited moods, irritated periods,
and times of depression. The drug works by restoring balance to the chemicals
in the brain. Besides these conditions, Risperdal is also used for off-label
treatments. To increase mood and heighten brain function, certain dementia
patients have been treated with the drug. Also, Risperdal has been used
to bring positive effects in patients with ADHD, sleep problems, and depression.
Lawsuits and Scandals Involving Risperdal
Hundreds of lawsuits have been filed against Johnson & Johnson, the
maker of Risperdal. The drug was first approved by the FDA in 1993. As
far back as 1994, questions of illegal marketing practices were raised.
By 1996, numerous prescriptions were written for unapproved and off-label
uses. As 1999 approached, reports surfaced about problems with Risperdal,
especially in children. Many doctors prescribed the drug when they felt
patients would receive benefits. However, Johnson & Johnson was not
allowed to promote the drug for off-label purposes. Unfortunately, evidence
came to light that showed the manufacturer had improperly marketed the
medication for its own financial gains.
Many lawsuits claim the drug caused victims to experience humiliation and
emotional trauma from breast growth. In 2012, the first lawsuit was introduced
by 21-year old Aron Banks. He claimed the drug caused great distress in
his life. It made him develop breasts. Despite the fact it was not approved
for use in children at the time, he took Risperdal from age 9. His breasts
grew extremely large, and he required surgical removal to return to a
normal size. Besides growing breasts, Aron gained a great deal of weight
and injured his endocrine system. All of these physical problems led to
psychological issues. After one day in court, this case was settled, but
the monetary award was never made public. Since then, several more lawsuits
have been filed. The Bloomberg News reported there were at least 420 lawsuits
pending against Johnson & Johnson concerning Risperdal. Approximately
100 involve patients with gynecomastia.
The U.S. Attorney General accused J&J of placing profits ahead of people’s
welfare. He claimed the company aggressively marketed to doctors in hopes
of increasing sales. This company encouraged physicians to prescribe the
drug to the elderly and young patients, even for off-label uses. Other
personal injury lawsuits alleging the manufacturer improperly marketed the drug without adequately
disclosing the risks. Since the pharmaceutical company failed to inform
patients about Risperdal’s dangers, it is responsible for damages
and should be held accountable for its negligence.
