Two Six-Year-Olds Drown in Half-Filled Abandoned Pool

Posted By Personal Injury Attorney || 5-Aug-2010

Two 6-year-old Muskegon Heights, Michigan children, died around noon on Mother's Day after slipped into a partially full, abandoned swimming pool located behind a vacant home in Muskegon Heights, reports say.

Ya'Mesha Mitchell and Torrey DayYa'Mesha were playing in the abandoned home when Torrey, the boy, fell into the pool. Mitchell threw him a rope and attempted to pull him out when she also fell in. Her sister, Yakyria Mitchell, 9, helplessly watched, according to family. The nine-year-old ran from the scene to her mother's home two blocks away, screaming and crying in an attempt to call for help, reports say.

Emergency personnel arrived at the scene around 12:30 p.m. after neighbors tried to assist, but both bodies were still in the stagnant pool water, making rescue efforts difficult. The two children were pronounced dead at Mercy Health Partners.

Reports say the children accessed the pool area through a small opening where a gate was loosely tied with a rope. The pool was surrounded by a large fence. There are no reports whether any criminal charges will be filed.

Old pools, open ponds, and river or beach access can easily kill small children who wander in and slide into the water unsupervised. In tragic circumstances such as these, the parents and family may seek to find a responsible party. After an accident, the responsible party's insurance company may try to reduce the claim amount. Commonly, insurance adjusters are trained to get information from the injured to assist in reducing the claim. Though some insurers are less guilty of this practice than others, it is important to realize that insurance companies are profit-oriented corporations and reducing claims results in increased profits for shareholders. This can create a situation for the injured in which they are offered a settlement that does not truly reflect the damages suffered. If you accept this settlement, you lose the ability to get more money should your injuries require further medical treatments. It is critical that victims get legal assistance in any personal injury case, and The Doan Law Firm is prepared to fight relentlessly for your rights.
