Botox Patient Wins $212-Million Suit

Douglas Ray Jr., 67, of Virginia, was awarded $212 million earlier this month by a U.S. District Court jury against the maker of Botox, Allergan Inc., alleging the drug left him brain damaged and disabled. The claim also states that the drug maker neglected to warn his physician about risks from the drug, reports say.

Mr. Ray received a Botox injection in 2007 for an issue with his hand, which shook and gave him cramps, reports say. The result, according the lawsuit and other reports, was that Ray now needs round-the-clock care.

This is not the first suit against Allergan. Reports say the company also settled a wrongful death lawsuit filed by the family and a $15-million judgment assessed by an Oklahoma jury in another Botox injury lawsuit. And last year, reports surfaced that Allergan reached an out-of-court settlement with the family of a woman who developed problems swallowing, and eventually needed a feeding tube. The family claimed the patient was never informed of Botox’s possible risks. Other reports have indicated patient hospitalization and death for children treated for cerebral palsy-associated limb spasticity, which is not specifically approved by the FDA, reports say.

Allegan manufactures two versions of Botox: Botox Cosmetic for the treatment of wrinkles; and Botox, which is approved to treat spasms and severe sweating.
